What the public record says about overlay widgets — with sources. Updated July 2026.
The short version: accessibility overlays promise one-line-of-code compliance. In January 2025 the FTC ordered the biggest overlay vendor, accessiBe, to pay $1,000,000 over exactly that promise, and lawsuit data shows that sites running overlays keep getting sued. The alternative isn't another widget — it's knowing the real WCAG issues in your own theme and fixing them at the source, with a dated evidence trail of your effort.
The overlay record, in three numbers

- The FTC order. The U.S. Federal Trade Commission alleged accessiBe's claims that its accessWidget could make any website WCAG-compliant were "false, misleading, or unsubstantiated", and that the company formatted paid reviews to look independent. The final order (April 2025) bars it from making those claims without evidence, for 20 years. FTC press release · final order.
- The lawsuit data. UsableNet's midyear 2025 report counted 456 lawsuits — 22.6% of all digital accessibility filings in H1 2025 — against websites that had a widget or overlay installed; complaints routinely cite that the overlay left the underlying code-level barriers in place. - The practitioners. Hundreds of accessibility professionals have signed the Overlay Fact Sheet, an open statement urging site owners not to rely on overlays as a compliance solution.

Why this matters now for store owners
US: ADA web lawsuits continued at thousands of filings per year through 2025, and plaintiff firms explicitly target sites that rely on widgets. EU: the European Accessibility Act has applied since 28 June 2025 and covers e-commerce offered to EU consumers (with limited microenterprise exemptions). If your store sells into the EU, accessibility is now a legal requirement on both sides of the Atlantic — and an overlay does not discharge it.
